This Privacy Policy applies to information that users provide to Coral8, Inc. ("Coral8", "we", "us") through the Coral8 website at www.coral8.com (the "Site") and through use of the Coral8 technology products and related services provided through the Site (collectively, the "Services").

Coral8 relies on you, our users, for our success. We know that in order for you to use our Services (for example, to download our software, to sign up for a web seminar or to request professional services or support assistance) or access certain areas of our Site, you have to feel comfortable providing us with personal information about yourself. We respect your privacy and recognize the importance of safeguarding the information that you share with us when you use our Site or Services.

This Privacy Policy informs you of our policies and procedures regarding the collection, use, disclosure, maintenance and protection of information that we collect from you as part of the normal operation of our Site and Services. Information We Collect

Personally Identifiable Information: In order to use some Services or access certain areas of this Site (for example, in order to receive newsletters or product information, sign up for a web seminar or request product or professional services support assistance), you may be required to submit personally identifiable information - for example, your name and email address - and other personal information as indicated in the applicable online registration form. At your option, you can also provide us with your company name, postal address, telephone number, fax number and URL, in addition to certain demographic information (such as income level, gender, job title/position, company industry/field of work, whether you have ongoing application development projects underway or planned; whether you have authority to make purchasing decisions or in influencing purchasing decisions and other general and industry information). Where possible, we indicate which fields are required and which fields are optional. Providing this additional information is entirely optional; we encourage you to submit this information so we can provide you a more personalized experience on our Site. You always have the option not to provide any information by choosing not to use a particular Service or access a certain area on the Site.

Other Information: When you visit the Site or use the Services, we collect certain data and statistics about your visit. Data we gather includes your internet protocol (IP) addresses, browser type, internet service provider (ISP), domain origination, referring/exit pages, operating system, date/time stamp, clickstream data (for example, which pages you click on), search terms and key words and numbers and types of downloads requests, email requests originating from the Site, sign-ups for web seminars, forum posts and IM communications. This information does not identify you personally, but rather identifies information about a visit to the Site. We use this information for internal purposes, such as to administer the Site, to improve the Site, to help us understand how the Site is being used, to analyze trends, to track users' movements around the Site, to analyze and understand our user's demographics, interests and behavior.

Cookies, etc.: Like many websites, we use "cookies" and other standard web technology to collect information for our own use. "Cookies" are small data files that we transfer to your computer's hard disk for record-keeping purposes. We use cookies for two purposes. First, we utilize persistent cookies to save your Coral8 membership ID and login password if you have configured your browser to do so for future logins to the Site and Services. Second, we utilize session cookies to enable certain features of the Site and Services, to better understand how you interact with the Site and Services, to measure promotional effectiveness, to monitor aggregate usage by our users and web traffic routing on the Site and to promote trust and safety. A session ID cookie expires when you close you browser. A persistent cookie remains on your hard drive for an extended period of time. You can remove persistent cookies by following directions provided in your Internet browser's "help" file. Aside from your Coral8 membership ID and your name, these cookies do not contain any personally identifiable information. Most Internet browsers automatically accept cookies. You can instruct your browser, by editing its options, to stop accepting cookies or prompt you before accepting a cookie from the sites you visit. If you do not accept cookies, however, you may not be able to use all portions of the Site or all functionality of the Services. Some of our business partners (e.g., advertising agencies) may place advertisements on the Site and may also use cookies of their own. We have no access to or control over these cookies. This Privacy Policy covers the use of cookies by Coral8 only and does not cover the use of cookies by any third parties.

Other:

(i) If you choose to access certain areas of the Site or use Services that require registration, we collect information about your use, access and behavior.
(ii) If you establish a credit account with us to pay the fees we charge, we collect some additional information, such as a billing address, a credit card number and a credit card expiration date and tracking information from checks or money orders.
(iii) If you choose to post messages in our forums, chat rooms or other message areas, or leave feedback for other users, we may collect that information you provide to us. We also may collect other users' comments about you in our feedback area. We retain this information as necessary to resolve disputes, provide customer support and troubleshoot problems as permitted by law.
(iv) If you send us personal correspondence, such as emails or letters, or if other users or third parties send us correspondence about your activities or postings on the Site, we may collect such information.
(v) If you register for Coral8 Services on another web site or use a web site providing a service for us, that web site may provide personal information about you and your transactions back to us. Remember that information you disclose on another web site is not governed by this Privacy Policy; different rules may apply to such other websites' use or disclosure of the information you disclose to them.

How We Use the Information We Collect

Our primary goal in collecting information from you is to provide you with a smooth and efficient experience while you're using our Site and Services and to keep you informed of opportunities available about the Site and Services. We use the information that you supply to us in several ways.

We associate your personally identifiable information with your site usage data in order to better understand and support you as a customer. For example, this data tells us what files are downloaded most frequently, which areas of the Site are most popular, and the average amount of time it takes to fulfill a request. You agree that we may use personal information about you to: improve our marketing and promotional efforts; analyze Site usage; improve our content and product offerings; customize the Site's content, layout and our Services; and improve the usability and efficacy of the Site. Compliance with Law: We may (and you authorize us to) disclose personally identifiable information that we believe necessary or appropriate, when required by law or under the good-faith belief that such disclosure is necessary in order to: (i) conform to applicable law; (ii) comply with a judicial proceeding, subpoena, search warrant, court order or other legal process; (iii) protect our rights, the property or interests of Coral8, its agents and employees from loss or liability, and the safety of the public or any person; (iv) prevent or stop any fraudulent, illegal, unethical or legally actionable activity (including in connection with an investigation of fraud, intellectual property infringement, piracy or other unlawful activity); and (v) enforce laws (including intellectual property rights). Under such circumstances, Coral8 may be prohibited by law, court order or other legal process from providing notice of the disclosure, and Coral8 reserves the right to not provide such notice in its sole discretion. In some cases, the government can compel the disclosure of information about you, and Coral8 will need to comply, in which case you authorize it to do so. You also consent to Coral8 disclosing information about you in connection with disputes involving other Coral8 members, and to actual or potential parties to a lawsuit or action that Coral8 is or may become involved in, (a) if Coral8 is required to do so, (b) if Coral8 reasonably believes that such disclosures will potentially mitigate its liability, or (c) for Coral8 to enforce its rights.

Business Transfers: As our business evolves, we may sell, transfer or otherwise share some or all of our assets, including information provided by you, in connection with a merger, reorganization or sale of some or all of our assets, or in the event of bankruptcy. In such an event, personally identifiable and other information may be one of the assets transferred.

Aggregate Information: Coral8 may share aggregated demographic information about our user base with our partners and advertisers, marketers and/or event sponsors for the purpose of assisting them with their marketing and promotional purposes. This information does not identify individual users. We do not link this aggregated demographic information with your personally identifiable information.

Postings: Because the Site and certain Services are accessible by other registered users, anything that you post in such common areas (such as the forum areas, chat rooms or bulletin board area) is available to such other users. If you use these areas, you should be aware that any personally identifiable information you submit there can be read, collected or used by other users in those areas, and could be used to send you unsolicited messages. Please be aware that others may illegally attempt to collect your email address from the Site. We are not responsible for the personally identifiable information you choose to submit in these areas. By editing your profile, you are able to specify whether, in certain areas of the Site, such as chat rooms or forums, you wish to share your name, company name or email address. If you choose to share such information, it will be visible to other users of the Site.

Reviewing Your Information and Requesting Changes

You may review the personally identifiable information we have on file by visiting the Developers section of the Site. There, you may correct, update, modify or delete information that is incorrect, as well as change your email preferences. Please note that, once posted, you may not be able to change or remove any public postings made on the Site including our chat rooms or other message areas. Our standard practice is to retain all registration records. However, if you wish to have your record deleted, please contact us and we will accommodate your request as soon as reasonably possible and in accordance with applicable law. Please note that if you wish to completely delete any information after you have submitted information on such fields, then your account may become deactivated.

We will retain in our files some personal information you have requested to remove to prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce our TOUs and comply with legal requirements as is permitted by law. Therefore, you should not expect that all of your personal information will be completely removed from our databases in response to your requests. However, such personal information will be deactivated from public and member viewing and will only be available to select Coral8 personal.

Additional Privacy Issues

Children's Privacy: The Site and Services are not directed to children under thirteen (13). We do not knowingly collect information from children under the age of thirteen and we do not target our Services to children under thirteen. If a parent or guardian becomes aware that his or her child has provided us with personally identifiable information without their consent, he or she should contact us at the address provided below. We do not ask children under the age of thirteen for information. If we become aware that a child under thirteen has provided us with personally identifiable information, we will use our best efforts to remove such information from our files.

Security: The security of your personal information is important to us. Coral8 shall take appropriate organizational and technical measures to protect the information provided to it or collected by it, and shall not retain it any longer than required in order to provide the Services or as required under relevant legislation. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. To maximize the security of your information, we suggest you select passwords that cannot easily be guessed and be sure to safeguard those passwords from disclosure. Phishing: We do not and will not, at any time, request personal information in a non-secure or unsolicited e-mail or telephone communication. Identity theft and the practice currently known as "phishing" are of great concern to us. Safeguarding information to help protect your from identity theft is our priority. International Data Transfer: Information submitted to us through this Site will be collected, processed, stored, transferred, disclosed and disposed of in accordance with applicable U.S. law. Information collected on the Site (for example, through registration to access certain Services) may be stored and processed in any country in which Coral8 maintains facilities or has relationships with service providers. If you are a non-U.S. visitor (including residents of the European Union or Canada), you acknowledge, agree and consent that we may use, collect, process, store, share, transfer, disclose and dispose of your personally identifiable information outside of your resident jurisdiction with Coral8 and Coral8-related entities worldwide and to other third parties in compliance with this Privacy Policy.

Surveys or Contests: From time-to-time, we may provide you with the opportunity to participate in surveys. We may also from time to time run promotions, sweepstakes or contests and may enter Coral8 members into such promotions, sweepstakes or contests. Participation in these activities is completely voluntary. If you choose to provide personal information in response to a survey, such information will be used for purposes of monitoring or improving the use of and satisfaction with the Site and Services, and improving our customer service and product and Services offerings. The requested information typically includes contact information (such as name and shipping address) and demographic information (such as zip code). If a promotion, sweepstakes or contest has an outside sponsor, the information you provide (such as your email addresses) may be shared with the sponsor. When necessary to deliver a prize, delivery information about the winner of a promotion, sweepstakes or contest may be shared with a third party.
